(Patents, Trademarks, Design)
Industrial property rights for Intellectual Property protect you against unlawful imitation, for example the adoption of your own inventions by competitors, who intend to save costs for their own development.
With a patent, trademark or design, the owner is granted a temporary (prohibitive) exclusive right to manufacture, apply and market the object of protection in recognition of his intellectual performance.
Industrial property rights can be obtained not only in Germany but also at European level – e.g. as a European Union trademark or Community design – as well as through joint application procedures based on international treaties in almost every non-EU country.
With our registration at the EU Trademark Office in Alicante, you can easily protect your trademark throughout the European Union. The same applies to the application of the so-called “International Trademarks / IR Trademark” at the WIPO in Geneva.
We advise our clients on the development (in particular the research), filing, defence and enforcement of industrial property rights and trademark portfolios before all national and international patent and trademark offices. In addition, we act for you before the German Patent and Trademark Office and the Federal Patent Court in Munich, the European Union Intellectual Property Office (EUIPO) in Alicante, the European Court of Justice (ECJ) in Luxembourg, the World Intellectual Property Organization (WIPO) in Geneva and the arbitration courts for domain disputes in Geneva and Prague.
Our network of international colleagues, with whom we have been cooperating intensively for many years, enables us to register and enforce intellectual property rights for you worldwide. We also take the contractual level into account, for example when licensing agreements extend beyond national borders.
In the case of cease-and-desist letters and infringement litigations in industrial property law, it is particularly important to know the particularities of the competent court. We have been representing our clients before all important regional and higher regional courts, in particular in Mannheim, Stuttgart, Frankfurt, Munich, Hamburg and Cologne/Düsseldorf for many years.
At MAS&P, two specialized lawyers work in the field of law. If necessary, they call in colleagues from other specialist areas, for example in labour or corporate law matters. In technical matters, we involve the patent attorney Dr.-Ing. Carsten Beyer, LLM, who is closely associated with us as a patent attorney for Germany and Europe.
